These Terms and Conditions (“Terms”) govern your use of the website https://getmyhealthchecked.com (the “Site”) and all services provided by GetMyHealthChecked, Inc. (“GetMyHealthChecked,” “we,” “our,” or “us”), including but not limited to: access to and completion of health questionnaires, physician-reviewed health reports, and referral recommendations (collectively, the “Services”).
By accessing or using our Site and Services, you (“you,” “user,” or “patient”) agree to these Terms. If you do not agree, you may not use the Services.
1. Services Provided
1.1 Annual Health Questionnaire
You may complete an online health questionnaire through the Site. Based on your responses, we generate a health report that is reviewed by a licensed physician before being provided to you. The report may include suggested next steps, including referrals for follow-up care.
1.2 No Emergency or Urgent Care
Our Services are not designed for emergency medical situations. If you believe you are experiencing a medical emergency, call 911 immediately or seek in-person medical attention.
1.3 No Ongoing Doctor–Patient Relationship
Use of the Services does not create a traditional physician-patient relationship, except as specifically disclosed in connection with your report review. Our Services are limited to reviewing questionnaire responses and providing informational guidance.
2. Eligibility & User Responsibilities
2.1 Eligibility
You represent and warrant that you:
are at least 18 years old (or the age of majority in your state of residence), or have verifiable parental consent;
are located in the United States when using the Services;
will provide accurate, complete, and current information.
2.2 Your Responsibilities
You agree to:
provide truthful and accurate health and demographic information;
use the Services only for your personal, non-commercial purposes;
not share your account or allow others to use it on your behalf;
comply with all applicable federal, state, and local laws.
3. Compliance with U.S. Health Privacy Laws
3.1 HIPAA Compliance
GetMyHealthChecked complies with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and related regulations. All personal health information (“PHI”) you provide will be safeguarded in accordance with HIPAA Privacy, Security, and Breach Notification Rules.
3.2 Business Associates
Physicians and third-party vendors assisting GetMyHealthChecked may qualify as “Business Associates” under HIPAA. We ensure such parties are bound by appropriate Business Associate Agreements (BAAs) to protect your PHI.
3.3 HITECH Compliance
In the event of a breach of unsecured PHI, GetMyHealthChecked will comply with all breach notification requirements under the HITECH Act, including notifying you and, if required, relevant authorities.
3.4 State Privacy Laws
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA). Our Privacy Policy explains how you may exercise these rights. Other state-specific protections may apply depending on your jurisdiction.
4. Use of Reports & Medical Disclaimer
4.1 Physician-Reviewed Report
Reports generated by GetMyHealthChecked are validated by a licensed physician. They are based solely on the information you provide through the annual health questionnaire. The physician’s review ensures that the report includes a professional medical assessment within the scope of a preventive checkup review.
4.2 What the Report Covers
The report may include:
A Health Risk Assessment (HRA), including lifestyle factors, family history, and behavioral health screening;
Review of self-reported metrics (such as weight, height, and blood pressure if provided);
Identification of potential gaps in preventive care;
A personalized prevention plan and general recommendations for maintaining or improving your health;
Referrals or recommendations for follow-up with your primary care provider or a specialist if medically indicated.
4.3 What the Report Does Not Cover
The report is preventive and informational in nature. It does not include or replace:
In-person physical examinations, laboratory testing, imaging, or diagnostic procedures;
Prescription or adjustment of medications;
Treatment or management of chronic conditions;
Diagnosis or treatment of new or acute medical issues;
Administration of vaccines or other in-office preventive services.
4.4 Limitations of the Report
The report relies entirely on the accuracy and completeness of the information you provide; omissions or inaccuracies may limit the physician’s ability to provide accurate guidance.
The physician’s review is confined to the information submitted via the questionnaire and does not involve access to your full medical record or direct physical evaluation.
The report is intended as a preventive checkup tool and does not replace a comprehensive in-person medical examination or ongoing care by your healthcare provider.
4.5 Medical Disclaimer
You should not disregard or delay seeking professional medical advice, diagnosis, or treatment based on your report. If you have new symptoms, urgent concerns, or suspect a medical condition, you should consult your primary care physician or seek immediate medical attention. In the event of a medical emergency, call 911 immediately.
5. Data Collection & Privacy
5.1 Types of Data Collected
Personal Identifiable Information (PII): name, date of birth, contact details, insurance details.
Protected Health Information (PHI): questionnaire responses, medical history, physician notes.
Technical Data: device, IP address, and browser information.
5.2 Data Use
We use your data for:
generating and reviewing your health report;
providing follow-up recommendations;
maintaining HIPAA compliance;
improving and developing our Services (in anonymized/aggregated form).
5.3 Data Sharing
We may share your PHI:
with physicians and licensed healthcare providers reviewing your report;
with third-party service providers (under BAAs) assisting us with operations;
if required by law, court order, or government authority;
with your written authorization.
5.4 Patient Rights Under HIPAA
You have the right to:
request access to and copies of your PHI;
request corrections to your PHI;
receive an accounting of disclosures;
request restrictions on certain uses/disclosures;
request confidential communications.
5.5 Data Retention
We retain PHI for as long as necessary to fulfill the Services and as required by law.
5.6 Email Address and Mobile Phone
By providing your email or mobile number, you consent to receive necessary communications related to the Services. Additional terms regarding communications are outlined in our Privacy Policy.
6. Security Measures
GetMyHealthChecked takes the protection of your Protected Health Information (PHI) very seriously. In compliance with the HIPAA Privacy, Security, and Breach Notification Rules, we maintain administrative, technical, and physical safeguards designed to ensure the confidentiality, integrity, and security of your PHI.
Our safeguards include, but are not limited to:
Administrative controls: workforce training on HIPAA compliance, strict access policies, and ongoing risk assessments;
Technical controls: data encryption in transit and at rest, secure authentication and session management, audit logs, and intrusion detection;
Physical controls: secure facilities, restricted access to servers, and environmental protections.
While no system can guarantee 100% security, GetMyHealthChecked follows industry best practices and federal requirements to minimize risks and respond quickly to any potential security threats. In the unlikely event of a data breach affecting your PHI, we will notify you promptly as required by the HIPAA Breach Notification Rule and applicable state laws.
We are committed to safeguarding your information and continuously improving our security measures.
7. Fees & Payment
7.1 Pricing and Disclosure
Some Services provided by GetMyHealthChecked may be offered at a cost. All applicable fees will be clearly disclosed to you before you confirm your purchase. Pricing may vary depending on the type of Service, location, and applicable promotions. GetMyHealthChecked reserves the right to update its fees at any time; however, any changes will be communicated to you in advance and will not affect Services already purchased.
7.2 Billing and Payment Processing
All payments are securely processed through trusted third-party payment processors in compliance with PCI-DSS (Payment Card Industry Data Security Standard) and other applicable financial regulations. By providing your payment information, you authorize GetMyHealthChecked and/or its payment partners to charge the applicable fees to your selected payment method.
Accepted payment methods may include credit cards, debit cards, or other forms of electronic payment as indicated during checkout. You are responsible for ensuring that your payment details are accurate and up to date.
7.3 Recurring or Subscription Payments
If you enroll in a subscription or recurring billing plan, you authorize GetMyHealthChecked to automatically charge your payment method at the agreed-upon intervals (e.g., monthly, annually) until you cancel. Cancellation policies and procedures will be made available at the point of purchase.
7.4 Taxes and Additional Charges
You are responsible for any applicable taxes, duties, or governmental charges associated with your purchase. These will be added to the fees where required by law.
7.5 Refunds and Credits
Unless otherwise expressly stated in writing, all fees are non-refundable once paid, including fees for partially used periods in subscription plans. Exceptions may apply in cases of billing errors, duplicate charges, or where required by applicable consumer protection laws. Any refunds granted will be processed back to the original payment method.
7.6 Failure to Pay
If your payment is declined or reversed, GetMyHealthChecked may suspend or terminate your access to the Services until payment is successfully completed. GetMyHealthChecked is not responsible for any fees charged by your bank, card issuer, or payment provider.
8. Intellectual Property
All content on the Site and within the Services, including questionnaires, software, reports, branding, and design, are owned or licensed by GetMyHealthChecked. You may not reproduce, modify, distribute, or exploit any content without our prior written consent.
9. Disclaimers & Limitations of Liability
9.1 Limited Scope of Services
GetMyHealthChecked provides Services designed to support annual medical checkups by collecting user health information, generating a report, and having that report reviewed by a licensed physician. These Services are limited in scope and are not a substitute for comprehensive medical care, emergency care, or ongoing treatment. Certain services, tests, screenings, or conditions may not be included, as outlined in Section 4 (“Use of Reports & Medical Disclaimer”).
9.2 No General Warranties
Except as expressly stated, the Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, or non-infringement. GetMyHealthChecked does not warrant that the Services will be error-free, uninterrupted, or meet all of your healthcare needs.
9.3 Limitation of Liability
To the fullest extent permitted by law:
GetMyHealthChecked, its officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of data, loss of profits, or reliance on the Services beyond their stated scope.
GetMyHealthChecked's maximum aggregate liability for any claim arising from or related to the Services shall not exceed the total amount you paid for the Services giving rise to the claim (if any).
9.4 User Responsibilities
You are responsible for providing complete and accurate information when using the Services. GetMyHealthChecked is not liable for inaccuracies or omissions resulting from false, incomplete, or misleading information provided by you. You are also responsible for following up with your primary care provider or other licensed healthcare professionals for ongoing care, treatment, and any medical concerns outside the scope of the Services.
9.5 Indemnification
You agree to indemnify, defend, and hold harmless GetMyHealthChecked, its officers, employees, contractors, affiliates, and agents from and against any claims, damages, liabilities, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your provision of inaccurate or misleading information.
10. Termination
We may suspend or terminate your access to the Services at any time for violations of these Terms or legal/regulatory reasons. You may stop using the Services at any time.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United States and the State of Delaware (where GetMyHealthChecked is incorporated). Disputes shall be resolved exclusively through binding arbitration under the rules of the American Arbitration Association (AAA), unless prohibited by applicable law.
12. Modifications
We may revise these Terms at any time. If material changes are made, we will provide notice through the Site or by email. Continued use of the Services constitutes acceptance of the updated Terms.
